On April 21, 2020, the US Environmental Protection Agency published the Navigable Waters Protection Rule in the Federal Register. The rule will come into effect on June 22, 2020. To help states and tribes better understand how the rule will change jurisdiction of Waters of the United States, ASWM has developed a document, entitled “ASWM Insights on the Final WOTUS Rule: The 2020 Navigable Waters Protection Rule”. This document includes key takeaways from the new rule, specific language and citations useful to wetland professionals and information about potential impacts for states and tribes, as well as early considerations around implementation.
